A group suing the City of Sturgeon Bay over a proposed hotel on the city’s west side waterfront has filed a brief in Door County Circuit Court asking for a summary judgment on the matter. The “Friends of the Sturgeon Bay Public Waterfront” says the summary judgment format allows a judge alone to decide the dispute, rather than engaging in a jury trial. The group contends the former Door County Cooperative property features filled in land and, as such, is public property and to sell the land for development purposes is not permitted under Wisconsin’s Public Trust Doctrine. The motion is expected to be acted on in December. Should the motion be denied, the trial is scheduled for February 9th and 10th.
