A 33 year old Brussels woman, charged with negligent homicide by intoxicated use of a motor vehicle, in connection with the death of her 8 month old daughter, waived her right to a preliminary hearing in Door County circuit court. Judge D. Todd Ehlers modified the county woman’s $25,000 bond, allowing her to enroll in a treatment program for alcohol & other drug abuse. As such, Martinez may sign herself out of jail for treatment, but must return to the jail when the program is completed. Her 8 month old daughter was found in a vehicle that had been left running with the heat on for an undetermined amount of time on October 19th. The child was pronounced dead at Ministry Door County Medical Center in Sturgeon Bay later that day. During the proceeding Thursday, defense attorney Jeffrey Jazgar of Green Bay indicated that he may file a motion related to one of the charges. A status hearing was scheduled for December 12th. Martinez has yet to enter a plea on the charges.
