Judge Rules Board of Adjustment Acted Within its Authority on Zip Line Approval

The Door County Board of Adjustment was acting within its authority when it approved a zoning code variance for a zip line at the Rowleys Bay Resort. Door County Judge D. Todd Ehlers handed down an opinion to that effect last week, denying a suit brought by the Town of Liberty Grove. The board’s action essentially allowed for the installation of the zip line & two climbing walls within an area of the resort property under 15 acres of space. The zoning code requires 20 acres. Judge Ehlers noted in his decision that the board of adjustment, which voted three to two to allow the variance, had properly carried out its function & acted within his authority. The town filed its lawsuit against the board of adjustment & Wagon Trail, Incorporated in May. The resort has been working with Door County Adventure in developing the zip line aerial slide.
